Privacy Statement

Introduction  

At MarketResponse, we are committed to protecting your privacy and ensuring the security of your personal information. This Privacy Statement outlines how we collect, use, disclose, and protect the information gathered through our website in compliance with the General Data Protection Regulation (GDPR) and other applicable data protection laws.  

Information We Collect and Use  

Data collection at our research projects  

In our research, we collect and process personal data: 

  • Through a panel agency:  
    • We obtain personal data from the respondent panel of a specialized agency. MarketResponse works with Dynata, Bureau Fris and Norstat 
  • Through or on behalf of a client:  
    • We obtain a set of personal data from employees, customers or another group directly from a client. 
    • We collect respondents via social media on behalf of the client. 

Respondentspanel 

The panel agency selects respondents from their panel who meet criteria compiled by MarketResponse, in consultation with the client. These criteria can be, for example, age, gender and place of residence. This data has been recorded by the agency with the respondent’s consent. The data is not accessible to MarketResponse. 

The panel agency sends an invitation to participate in the study on behalf of the client. In this way, we do not receive any personal data from the respondents.  

In exceptions, the panel agency provides data so that we send the invitations. This data then only contains the email address and name of the respondent. 

Client 

The client remains responsible for the processing of the data. We are the processor in this situation. The personal data is contact details and may include a name, an email address and/or a telephone number. 

We use the personal data to send you a questionnaire. After returning the questionnaires, we will delete the personal data from the survey. Our clients do not receive any answers, and therefore no personal data, from respondents. 

Data processing 

In our investigations, as a processor for our clients, we carry out processing with personal data:  

  1. Prior to the research, we send out the invitations for research by name and email. We use the basis that the client has determined for the research. 
  2. During the research, we make audio or video recordings, summaries and transcripts of interviews or assignments in order to properly process the answers to questions. On behalf of the client, we explicitly ask for your consent as the basis for the processing. 

The team that is involved in the research at our client may be able to watch and listen in on an interview with you or assignments you make. They do not receive copies of recordings or assignments made. 

In our research we collect and process personal data. This personal data is provided by a client, who is the controller of the data. We are the processor in this situation. The personal data are contact details and may include a name, an email address, and/or a phone number.  

We use this information to send you a questionnaire. After the return of the questionnaires, we remove the personal data.   

Data collection at our corporate website   

We process personal data if you visit our website and the personal data you enter on www.marketresponse.nl and/or www.marketresponsegroup.com for sending information for managing:  

  • your subscription to newsletters  
  • your attendance to a MarketResponse event  
  • your download of our content or  
  • your submission in the contact or chat form and answer your question or request.   

We collect the personal information that you voluntarily provide to us when you interact with our website. This includes your name, email address, phone number. When entering this data, you will always be informed about how we will process the data.  

Next to that, we collect your surfing behavior on the website when you consent to the use of statistical and advertisement cookies and share this information outside the EEA with Google (Analytics and Youtube).  

Like many websites, we may also automatically collect information about your device and usage patterns when you visit our website, such as your IP address, browser type, operating system, referring URL, pages visited, and the dates and times of your visits.  

Marketing Communications  

We use the information we collect to send you marketing communications about our products, services, promotions, and events that we believe may be of interest to you. You have the right to opt-out of receiving these communications at any time by following the unsubscribe instructions provided in the communication.  

Personalization  

We may use the information to personalize your experience on our website, including by displaying targeted advertisements and content that we believe may be relevant to your interests.  

Transactional Purposes  

We use the information to fulfill your requests, process your transactions, provide you with customer support, and communicate with you about your account or any inquiries you may have. We also use personal data to contact you in research processes.  

Legal Compliance  

We may use the information to comply with applicable legal obligations, such as responding to lawful requests from government authorities and enforcing our terms and policies.  

Disclosure of Information  

Service Providers  

We share your information with third-party service providers who assist us in operating our website, conducting our business, or servicing you, such as hosting providers and marketing software services. These service providers are contractually obligated to use the information only for the purposes of providing the services to us and in accordance with our instructions.  

Business Transfers  

In the event of a merger, acquisition, reorganization, bankruptcy, or other sale of all or a portion of our assets, your information may be transferred to the acquiring entity or successor-in-interest.  

Legal Requirements  

We may disclose your information if we believe it is necessary to (a) comply with a legal obligation, (b) protect and defend our rights or property, (c) prevent or investigate possible wrongdoing in connection with our website, (d) protect the personal safety of users of our website or the public, or (e) enforce our legal agreements and policies.  

Data Subject Rights  

As a data subject, you have several rights to enforce your privacy with us. To do this, please send an email to fg@marketresponse.nl. Please provide a description of your request. As proof of your identity we will ask a confirmation via the email address we have of you. We will respond to your request within four weeks.  

You have the following rights:  

  • Access: You have the right to request access to the personal information we hold about you. You will receive a copy of the data we have collected from you.   
  • Rectification: You have the right to request that any inaccuracies be corrected. You will receive a notification after the correction.  
  • Data Portability: You have the right to receive a copy of your personal information in a structured, commonly used, and machine-readable format and to transmit it to another controller.  
  • Erasure: You have the right to request that we erase your personal information under certain circumstances, such as when it is no longer necessary for the purposes for which it was collected. You will receive a notification after the erasure. Please, be aware that if we are the processor, we can only delete your data in our own systems. If a controller retains your personal data as well, you may also have to contact the controller directly. 
  • Objection: You have the right to object to the processing of your personal information under certain circumstances, such as when we are relying on legitimate interests as the legal basis for processing.  
  • Restriction of Processing: You have the right to request that we restrict the processing of your personal information under certain circumstances, such as when you contest the accuracy of the information or the lawfulness of the processing. You will receive a notification after the restriction.  
  • Right to not be subjected to automated decision-making: You have the right to not to be subject to automated decision-making. This includes profiling. MarketResponse does not use automated decision-making or profiling.  
  • Right to revoke your consent: You may revoke your consent, for example at our newsletter.  

Data Security  

Security Measures  

We implemented appropriate technical and organizational measures to protect the security and confidentiality of your personal information against unauthorized access, disclosure, alteration, and destruction. We also ensure that we conclude the required contractual agreement with third parties. We find it most important to ensure that the third party applies the same level of security.  

Data Transfers  

Transfer Mechanisms  

We use software services to transfer your personal information outside of the European Economic Area (EEA).  We see to it that adequate safeguards are in place to protect your privacy rights, such as by using standard contractual clauses approved by the European Commission.  

Retention Period  

We will retain your personal information for as long as necessary to fulfill the purposes for which it was collected. Until you unsubscribe to our newsletter, we will store your data for marketing purposes. You can do this at any time by clicking “unsubscribe” at the bottom of all our marketing email and complete the cancelation of your subscription.  

Children’s Privacy  

Age Limitation  

Our website is not intended for children under the age of 18, and we do not knowingly collect personal information from children under this age. If you are a parent or guardian and believe that your child has provided us with personal information, please contact us so that we can delete the information.  

Updates to this Privacy Statement  

Changes  

We may update this Privacy Statement from time to time to reflect changes in our practices, legal requirements, or other factors. We will notify you of any material changes by posting the updated Privacy Statement on our website and updating the “Last Updated” date at the top of the statement.
