At MarketResponse, we are committed to protecting your privacy and ensuring the security of your personal information. This Privacy Statement outlines how we collect, use, disclose, and protect the information gathered through our website in compliance with the General Data Protection Regulation (GDPR) and other applicable data protection laws. 

Information We Collect and Use 

Data collection at our research projects 

In our research we collect and process personal data. This personal data is provided by a client, who is the controller of the data. We are the processor in this situation. The personal data are contact details and may include a name, an email address, and/or a phone number. 

We use this information to send you a questionnaire. After the return of the questionnaires, we remove the personal data.  

Data collection at our corporate website  

We process personal data if you visit our website and the personal data you enter on www.marketresponse.nl and/or www.marketresponsegroup.com for sending information for managing: 

  • your subscription to newsletters 
  • your attendance to a MarketResponse event 
  • your download of our content or 
  • your submission in the contact or chat form and answer your question or request.  

We collect the personal information that you voluntarily provide to us when you interact with our website. This includes your name, email address, phone number. When entering this data, you will always be informed about how we will process the data. 

Next to that, we collect your surfing behavior on the website when you consent to the use of statistical and advertisement cookies and share this information outside the EEA with Google (Analytics and Youtube). 

Like many websites, we may also automatically collect information about your device and usage patterns when you visit our website, such as your IP address, browser type, operating system, referring URL, pages visited, and the dates and times of your visits. 

Marketing Communications 

We use the information we collect to send you marketing communications about our products, services, promotions, and events that we believe may be of interest to you. You have the right to opt-out of receiving these communications at any time by following the unsubscribe instructions provided in the communication. 

Personalization 

We may use the information to personalize your experience on our website, including by displaying targeted advertisements and content that we believe may be relevant to your interests.

Data Subject Rights 

As a data subject, you have several rights to enforce your privacy with us. To do this, please send an email to fg@marketresponse.nl. Please provide a description of your request. As proof of your identity we will ask a confirmation via the email address we have of you. We will respond to your request within four weeks. 

You have the following rights: 

  • Access: You have the right to request access to the personal information we hold about you. You will receive a copy of the data we have collected from you.  
  • Rectification: You have the right to request that any inaccuracies be corrected. You will receive a notification after the correction. 
  • Data Portability: You have the right to receive a copy of your personal information in a structured, commonly used, and machine-readable format and to transmit it to another controller. 
  • Erasure: You have the right to request that we erase your personal information under certain circumstances, such as when it is no longer necessary for the purposes for which it was collected. You will receive a notification after the erasure. Please, be aware that if we are the processor, we can only delete your data in our own systems. If a controller retains your personal data as well, you may also have to contact the controller directly.
  • Objection: You have the right to object to the processing of your personal information under certain circumstances, such as when we are relying on legitimate interests as the legal basis for processing. 
  • Restriction of Processing: You have the right to request that we restrict the processing of your personal information under certain circumstances, such as when you contest the accuracy of the information or the lawfulness of the processing. You will receive a notification after the restriction. 
  • Right to not be subjected to automated decision-making: You have the right to not to be subject to automated decision-making. This includes profiling. MarketResponse does not use automated decision-making or profiling. 
  • Right to revoke your consent: You may revoke your consent, for example at our newsletter. 

Data Security 

Security Measures 

We implemented appropriate technical and organizational measures to protect the security and confidentiality of your personal information against unauthorized access, disclosure, alteration, and destruction. We also ensure that we conclude the required contractual agreement with third parties. We find it most important to ensure that the third party applies the same level of security. 

Data Transfers 

Transfer Mechanisms 

We use software services to transfer your personal information outside of the European Economic Area (EEA).  We see to it that adequate safeguards are in place to protect your privacy rights, such as by using standard contractual clauses approved by the European Commission. 

Retention Period 

We will retain your personal information for as long as necessary to fulfill the purposes for which it was collected. Until you unsubscribe to our newsletter, we will store your data for marketing purposes. You can do this at any time by clicking “unsubscribe” at the bottom of all our marketing email and complete the cancelation of your subscription. 

Children’s Privacy 

Age Limitation 

Our website is not intended for children under the age of 18, and we do not knowingly collect personal information from children under this age. If you are a parent or guardian and believe that your child has provided us with personal information, please contact us so that we can delete the information. 

Updates to this Privacy Statement 

Changes 

We may update this Privacy Statement from time to time to reflect changes in our practices, legal requirements, or other factors. We will notify you of any material changes by posting the updated Privacy Statement on our website and updating the “Last Updated” date at the top of the statement.

Privacy Statement qualitative research Dynata 

This privacy statement concerns respondents who are approached to participate in qualitative research at MarketResponse through our partner Dynata. 

We are MarketResponse. We conduct market research to provide organizations (our clients) with insights that help them better connect with (potential) customers. These can also be citizens in the case of governments. 

MarketResponse’s research includes qualitative research in which people (respondents), for example, participate in interviews, group discussions or complete assignments. This can be organized both online and physically. We only do this with the respondent’s permission; so you! We are happy to explain it in this document.

MarketResponse processes your data securely and takes your privacy seriously: 

  • We inform you about what it means to participate in qualitative research. We only collect and process your personal data when you give permission. 
  • We collect and process personal data such as Dynata ID, email address, telephone number and name in order to invite you to the research and meet you during the research. 
  • We only collect this personal data for a specific research project; namely the research for which we are currently inviting you. We do not use your personal data for other purposes, except when we ask your prior, explicit and separate permission for another use. 
  • This personal data may be shared with our partners (sub-processors). They also only use your personal data for the relevant research project. They adhere to the same agreements as we do, including with regard to deleting data. You can always request a list of possible sub-processors with whom we have fixed agreements. This can be done via fg@marketresponse.nl. 
  • These partners are not located outside the EU, nor do we store any data outside the EU ourselves. 
  • Our clients do not receive personal data from respondents. 
  • The team that is involved in the research of our client may be able to watch and listen to an interview with you or assignments that you complete. They do not receive copies of recordings or assignments made, unless we ask you for explicit and separate permission to do so. 
  • Personal data and video or audio recordings will be kept for a maximum of 6 months after completion of the research based on client needs. 
  • Automated decision-making, such as profiling, with information about your daily life does not apply. 
  • If you decide not to share your personal data with us, you will not participate in the qualitative research. This may be a shame for us, but this will have no further consequences for you. 
  • You can always request what data MarketResponse has about you via fg@marketresponse.nl. 
  • You can always report changes to the data that MarketResponse has about you via fg@marketresponse.nl. 
  • You can always indicate that you want MarketResponse to stop using your data and/or delete it via fg@marketresponse.nl. 
  • If you have a complaint, you can submit it to the Dutch Data Protection Authority. 

This Privacy Statement is subject to change. These changes are always announced on the website, so we recommend that you check the privacy statement on the website for any changes.
